These Terms & Conditions govern access to and use of the Sky Educate website, including any registration, account, recruitment, school hiring, consultancy, communication, and related services made available through skyeducate.com (the “Platform”). Sky Educate presents itself as an international education consultancy and recruitment service serving schools and education professionals worldwide.
By creating an account, checking the acceptance box, submitting information, or otherwise using the Platform, each user agrees to be bound by these Terms & Conditions. These Terms apply to both individuals seeking employment or career opportunities (“Candidates”) and schools, organisations, recruiters, or other entities seeking to advertise roles or identify talent (“Schools” or “Employers”).
1. About the Platform
Sky Educate provides services connected to international education, including consultancy, professional development, school support, and recruitment-related services. The Platform is intended to help Candidates present their profiles and applications and to help Schools and Employers advertise opportunities, review relevant candidate information, and connect with potential hires.
Sky Educate acts as an intermediary platform and service provider unless expressly stated otherwise in a separate written agreement. Sky Educate is not the employer of any Candidate and, unless expressly agreed, is not a party to any employment contract entered into between a Candidate and a School or Employer.
2. Eligibility and Acceptance
To register or use the Platform, users must be legally capable of entering into binding agreements under applicable law. If a user registers on behalf of a School, organisation, or other entity, that person confirms they have authority to bind that entity to these Terms.
Registration is conditional upon acceptance of these Terms & Conditions and the Privacy Policy. No Candidate or School may complete registration without affirmatively accepting these Terms.
3. User Categories
3.1 Candidates
Candidates may register to create a profile, upload CVs or resumes, submit applications, receive communications, and be considered for employment, consultancy, supply, leadership, or other education-related opportunities made available through the Platform.
3.2 Schools and Employers
Schools and Employers may register to post vacancies, review applications, search or receive candidate information where permitted, and communicate with Candidates for legitimate recruitment or staffing purposes.
4. Account Registration
All users must provide accurate, current, and complete information when registering and must keep that information updated. Sky Educate may suspend, restrict, or terminate any account where information is false, misleading, incomplete, outdated, or cannot be verified.
Users are responsible for maintaining the confidentiality of login credentials and for all activity occurring under their accounts. Users must notify Sky Educate promptly of any suspected unauthorised access, breach, or misuse of their account.
Sky Educate may refuse registration or remove accounts at its discretion where necessary to protect the Platform, comply with legal obligations, prevent fraud, preserve service quality, or respond to misuse.
5. Candidate Obligations
Candidates agree that all information submitted through the Platform, including identity details, qualifications, certifications, work history, references, safeguarding disclosures, visa or work authorisation status, and supporting documents, will be truthful, accurate, and not misleading.
Candidates must ensure they have the right to work, teach, or provide services in the relevant jurisdiction where required by law or by the hiring School. Candidates remain responsible for reviewing and accepting the terms of any employment offer or contract issued by a School or Employer.
Candidates must not impersonate another person, misrepresent qualifications, submit documents they are not authorised to use, or use the Platform for unlawful, abusive, or fraudulent purposes.
6. School and Employer Obligations
Schools and Employers agree that vacancies, profiles, and communications posted or sent through the Platform will be genuine, lawful, accurate, and related to bona fide education or school-support opportunities. Each School or Employer is solely responsible for its job postings, hiring processes, safeguarding checks, interviews, offers, employment decisions, and compliance with employment, immigration, tax, child-protection, and regulatory requirements applicable to the role and jurisdiction.
Schools and Employers must not post misleading vacancies, collect candidate information for unrelated marketing purposes, harvest candidate data, or contact Candidates except for legitimate recruitment or related professional purposes. Sky Educate may remove postings or restrict accounts that appear misleading, unlawful, discriminatory, exploitative, or inconsistent with the purpose of the Platform.
7. Acceptable Use
Users must use the Platform only for lawful purposes and in a way that does not infringe the rights of others, compromise platform security, or interfere with the operation of the website.
Users must not:
- Upload malware, viruses, or harmful code.
- Scrape, harvest, copy, or extract data without permission.
- Reverse engineer, decompile, or attempt to gain unauthorised access to the Platform.
- Use automated tools or bots except where expressly authorised in writing.
- Post defamatory, obscene, threatening, hateful, deceptive, infringing, or otherwise unlawful material.
Sky Educate reserves the right to investigate suspected misuse and to remove content, suspend access, or report conduct to relevant authorities where appropriate.
8. User Content and Materials
Users retain ownership of the documents and information they submit, subject to the rights necessary for Sky Educate to host, process, copy, display, transmit, and share that content for the operation of the Platform and related recruitment or consultancy services.
By submitting content, the user confirms that they have all rights, permissions, and lawful bases required to provide that content and to allow its use for these purposes.
Candidates acknowledge that application materials may be made available to Schools or Employers to whom they apply or with whom they choose to share their profile. Schools and Employers acknowledge that candidate data received through the Platform must be used only for recruitment, evaluation, safeguarding, compliance, and related hiring purposes, and must be handled in accordance with applicable data protection law.
9. Privacy and Data Protection
Use of the Platform is also governed by the Sky Educate Privacy Policy, which explains how personal data is collected, used, stored, shared, and retained.
By registering or using the Platform, users acknowledge that relevant personal data may be processed to:
- Operate accounts and deliver services.
- Facilitate recruitment and communication.
- Respond to enquiries and support requests.
- Improve platform functionality and security.
- Comply with legal and regulatory obligations.
Candidates understand that information submitted through the Platform may be disclosed to relevant Schools or Employers in connection with applications, profile sharing, or recruitment-related enquiries. Schools and Employers agree that they are responsible for their own lawful handling of candidate data after receipt.
10. Fees and Paid Services
Sky Educate may offer free and paid services, including recruitment support, advertising, consultancy, training, featured listings, or subscription-based services.
Where fees apply, pricing, billing terms, and any refund arrangements will be communicated separately on the website, in an order form, or in a separate written agreement. Unless otherwise stated in writing, fees paid are non-refundable once services have commenced or a posting, campaign, search, or consultancy engagement has been activated.
Sky Educate may amend pricing, service features, or packages from time to time, subject to any separate contractual commitments.
11. No Guarantee of Outcomes
Sky Educate does not guarantee that any Candidate will obtain employment or that any School or Employer will fill a vacancy through the Platform.
Sky Educate also does not guarantee the accuracy, completeness, suitability, legality, or credentials of user-submitted materials, although it may conduct checks or reviews at its discretion.
All hiring decisions, contractual negotiations, due diligence, visa checks, safeguarding reviews, reference checks, and employment terms remain the responsibility of the Candidate and the hiring School or Employer.
12. Safeguarding and Compliance
Because the Platform relates to education and child-facing environments, Schools and Employers are responsible for carrying out all legally required safeguarding, identity, background, reference, qualification, and right-to-work checks before engagement or appointment.
Candidates must cooperate with reasonable requests for documentation, references, identity verification, safeguarding declarations, and compliance information required for a role.
Sky Educate may remove any user, vacancy, or material where safeguarding, legal, ethical, or reputational concerns arise.
13. Intellectual Property
The Platform, including its design, text, graphics, branding, software, databases, and content made available by Sky Educate, is owned by or licensed to Sky Educate and is protected by applicable intellectual property laws.
Users may not copy, reproduce, distribute, modify, create derivative works from, republish, scrape, or commercially exploit any part of the Platform except as expressly permitted in writing.
Nothing in these Terms transfers ownership of Sky Educate intellectual property to any user.
14. Third-Party Links and Services
The Platform may contain links to third-party websites, services, or tools for convenience. Sky Educate is not responsible for third-party content, availability, security, or practices, and access to third-party services is at the user's own risk.
15. Suspension and Termination
Sky Educate may suspend, restrict, or terminate access to the Platform, remove content, or disable accounts at any time where there is a suspected breach of these Terms, legal risk, safeguarding concern, non-payment, fraud, misuse, reputational risk, or inability to verify account information.
Users may stop using the Platform at any time. Requests for account closure or deletion will be handled in accordance with applicable law and the Privacy Policy, subject to retention requirements and legitimate business needs.
Termination does not affect accrued rights, payment obligations, or provisions intended to survive termination, including clauses relating to liability, indemnity, intellectual property, confidentiality, and governing law.
16. Disclaimers
The Platform and all related content and services are provided on an “as is” and “as available” basis to the fullest extent permitted by law.
Sky Educate does not warrant that the Platform will be uninterrupted, secure, error-free, compatible with every device or system, or free from viruses or other harmful components.
To the fullest extent permitted by law, Sky Educate disclaims all implied warranties, including implied warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement.
17. Limitation of Liability
To the fullest extent permitted by law, Sky Educate shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, contracts, opportunity, goodwill, data, or anticipated savings arising out of or in connection with use of the Platform.
Sky Educate is not responsible for acts or omissions of Candidates, Schools, Employers, advertisers, referees, third-party service providers, or other users of the Platform.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded.
18. Indemnity
Users agree to indemnify and hold harmless Sky Educate, its officers, employees, contractors, and affiliates against claims, liabilities, damages, losses, and reasonable costs arising from their misuse of the Platform, breach of these Terms, violation of law, infringement of rights, or content submitted by them, to the extent permitted by law.
19. Changes to the Terms
Sky Educate may update these Terms & Conditions from time to time by posting a revised version on the website. Updated Terms take effect from the stated effective date unless a different date is specified.
Where legally required, Sky Educate will take reasonable steps to notify registered users of material changes. Continued use of the Platform after the effective date of revised Terms constitutes acceptance of the updated Terms.
20. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the jurisdiction where Sky Educate is established, unless otherwise required by mandatory local law.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts selected by Sky Educate in the final published version of these Terms.
